We will review dashboard videotape of the field sobriety test and other evidence to determine if the police had reason to charge you with DWI. Defense strategy three involves reviewing the Breathalyzer test evidence. Currently, the police are switching from the intoxilyzer machine to the intoximeter machine. Regardless of the type of machine, there are requirements for calibration. If a machine is not properly calibrated, or there are flaws in the way the machine was used, the evidence may have to be thrown out, which can lead to the case being dismissed.
Defense strategy four involves looking at the way the arrest and the release were handled after bond was made. If the process was handled improperly, it cut off chances of having follow up testing done, which could lead to dismissal of the case.
